A divorce attorney's take on marriage, divorce, and motherhood: What modern women need to know

In this episode of The Mission Motherhood Show, I sit down with James W. Evans, a board-certified family law attorney, to talk about what modern women need to understand before marriage, divorce, fertility decisions, and motherhood become legally complicated.

This is a deeply personal conversation for me because James, or Jimmy as I know him, was my divorce attorney during one of the most difficult seasons of my life. He helped me navigate a complex family law battle involving legal separation, donor conception, presumed father laws, custody, and the painful reality that modern family-building often moves faster than the law.

We talk about the danger of choosing “Prince Convenient” when the biological clock is ticking, why women need to understand their legal and financial protections before stepping back from a career to have children, and why conversations about money, property, custody, work, and future caregiving should happen before life becomes complicated.

James explains why prenups and postnups are not just for wealthy couples or people expecting divorce. They can be practical tools that help women protect themselves, their children, their families, and the future they are working so hard to build.

We also discuss what happens when informal agreements are not legally enforceable, why staying married but living separate lives can create unexpected risks, and how donor conception, IVF, and single motherhood by choice can become legally vulnerable when old laws are applied to modern families.

This conversation is not meant to scare women.

It is meant to empower them.

Because whether you are married, separated, considering divorce, stepping back from your career, pursuing motherhood on your own, using assisted reproductive technology, or trying to protect your future family, knowledge matters.

An ounce of advance planning and legal advice can save women from years of uncertainty, emotional strain, and tens of thousands of dollars in attorney fees later.

My hope is that this episode helps women ask better questions earlier, protect themselves more thoughtfully, and make decisions about marriage, divorce, and motherhood with clarity instead of crisis.
